Asylum / Withholding of Removal

The United States maintains protections for certain immigrant who are seeking freedom from persecution.
The United States Asylum laws allow foreign nationals to legally immigrate based on fleeing their countries from a political situation, or persecution of their race, religion, nationality, or membership in a social group. Most Asylum cases are filed by undocumented immigrants who are detained at a port of entry to the United States.
An affirmative asylum application can be filed with USCIS or through the immigration court (Executive Office for Immigration Review) if removal proceedings have already been initiated.
